DUNBARTON BOARD OF SELECTMEN
TOWN OFFICES –
The regular scheduled weekly meeting of the Dunbarton Board of Selectmen was held at the above time, date and place with Chairman Charles Graybill presiding. The following were present:

J.
R. Swindlehurst, Dunbarton Fuel, explained the situation. He stated the old system had been taken out
this summer. The hold up was it was a
Warranty problem with the Heat Exchanger and Combustion Chamber. Has already fixed the Heat
Exchanger on his own. The combustion Chamber has already been shipped
and will arrive tomorrow (10/3). It will
be installed within a week. Stated he
has spoken with Andrea Douglas, Librarian, and let her know the situation.
Steve Kennedy stated that he and Ken Swayze had done a recent site visit. Stated the Selectmen need to do another site visit inspection regarding the removal of any health issues regarding the granting of a CO for the second mobile home. The metal and wood has been separated, usable lumber is in a large pile. You cannot tell there was a trailer there any more. Metal will be taken to the Transfer Station. Karen Meehan stated she will have to borrow the truck again to take the metal. The following was noted by Steve Kennedy:
1. The replacement mobile home for the burned unit is in good repair with the exception of needing to have a fire inspection.
2. Have issued an authorized for Public Service Company to hook up electricity.
3. Town will contract with a private contractor to do an inspection of the septic system currently occupied by Tom Gleason to validate previous Health Inspector/Building Inspector’s findings.
4. Town will also have the private contractor inspect the septic system where the burned trailer was previously (now replaced) before issuing a CO.
5. Would advise the Meehan’s to make some determination as to where tenant’s “property line” is located. This was so the Town could determine responsibility. Would suggest they check with the Board of Assessors as to how determination could be made. K. Meehan stated they have already done this and will provide it to the Selectmen.
MOTION:
Steve Kennedy made a motion
that the Town of Dunbarton pay the cost for inspections of the two septic
systems on the Meehan property, specifically the Tom Gleason mobile home and
the previously burned mobile home (where replacement mobile home is located) to
determine viability of septic systems.
J. R. Swindlehurst seconded the motion.
The motion passed unanimously.
Karen Meehan stated she had questions as follows:
1. What are the requirements for a Home Occupation and how many vehicles are allowed for the business?
2. Does Tom Gleason have a permit for a Home Occupation for his business?
3. Stated that Tom Gleason parks his Trash Removal truck on the left side of the home and starts it and it fumigates the tenant’s bedroom. It should be pulled away from that unit.
4. Stated there should be a letter in her file regarding her concerns about this. When is the Town going to do something about it?
5. Stated the truck doing business is parking in the back and the one in the front is for sale.
6. Would like to make sure that Mr. Gleason is not letting the water run onto the septic system to cause failure, etc. He had admitted this in court at one time.
7. Would like a copy of any permit that is granted to Gleason for a Home Occupation, etc.
S. Kennedy stated that there had been an inspection on July 4 and K. Swayze had taken pictures of trash, etc. Has been cleaned up and have not seen this type of violation again.
It was determined at this time by Ken Swayze that there is no permit for a Home Business for Tom Gleason. Tom Gleason stated he understood his use was grandfathered. K. Swayze noted that he would need a permit for a Home Business and the use was not grandfathered.
Tom Gleason
1. Tom Gleason stated he would object if the Meehan’s were given a CO for the replacement mobile home until his leach field is fixed. Would suggest that his trailer be connected to the septic system instead which would be used for the replacement mobile home.
2. Selectmen stated that if Tom Gleason’s system is determined failed, then they can order the Meehan’s to fix the system. This has nothing to do with the CO for the replacement mobile home. If the replacement mobile home septic system is failed, they will not issue the CO until the system is fixed.
3. Selectmen informed Tom Gleason he must do something about the vehicles on the property.
4. In addition, Selectmen informed Tom Gleason he must move the wood that is on top of the leach field.
Dick Gleason
1. Janice VandeBogart provided the latest copy of the job description for the Transfer Station Supervisor.
(She noted it should be updated).
2. Steve Kennedy stated he realized there had been a “rift” between the parties and the Transfer Station Supervisor but they must get this behind them. Stated the Town was trying to take care of Commercial Haulers by working on having the Transfer Station open more hours for them in the near future.
Mike Brown and Gary Chicoine appeared before the Board of Selectmen as owner and contractor.
1. Noted that all bounds have been set. Shoulders have been shimmed.
2. Selectmen suggested that the amount of $27,500 be rolled over until spring to determine winter damage, etc.
Members of the Public:
Ron Slocum asked if the Town Engineer had inspected this road and whether there is anything outstanding on the list that should be completed. Asked if all runoff and side ditches are all taken care of and wants to make sure there will be no erosion problems for the next five years.
It was noted that Phase I is complete and Phase II is pretty nice also. Owner had done culvert work on the road which has been a big improvement.
MOTION:
Steve Kennedy made a motion that the Town of Dunbarton accept a total of $27,500 for Jay Drive and stipulate that $9,000 will be for Phase I to be reviewed after May 1, and $18,500 be held in bond for Phase II. Building Permits will be issued and lots will be sold. J. R. Swindlehurst seconded the motion. The motion passed unanimously.
The above three parties appeared
before the Board of Selectmen to determine what upgrades would be required on
Jacques Belanger, Surveyor, presented a plan showing the proposed subdivision and noted that the road narrows by the Carla Holden property. He stated Carla Holden had agreed to a land swap to provide more land to widen and improve the road if required. This would also give her more land to do improvements without having to seek a Variance. He stated they would like to create three lots.
Steve Kennedy stated that the
land had a use when you bought it. Now
you have changed the use of the land so the road is not adequate. Do we want to scrap that
It was noted that the way the road is now, you can’t get a fire truck or snow plow down there.
J. Belanger, Surveyor, stated the scenic value of the road has already been lost by the improvement to the other side of the road.
It was noted that if someone owned both sides of the road, you would have to bring the road up to Class V standards and pave it. The idea is to share the financial impact. Selectmen would require bring it up to Class V standards but not necessarily paved.
J. R. Swindlehurst stated he felt the Selectmen should stick to the existing road policy.
Charles Graybill stated he felt the Selectmen should stick to the existing road policy also.
It was noted that they should come before the Board of Selectmen with a road profile showing the proposed improvements.
MOTION:
A motion was made, seconded
and passed by a majority vote that Stone Road be brought up to Class V Standard
by the Michaud’s as a part of the proposed subdivision. The vote was as follows:

OTHER BUSINESS:
1. Perambulation of Bow/Dunbarton Town Line -
Fred Mullen and John R. Swindlehurst II were assigned to the Perambulation

Appointment for setting the new Tax Rate was scheduled
for Friday morning,
3. Safe in Town Clerk’s Office – Janice VandeBogart was advised by the Selectmen to hire Adams Lock and Safe to open it. Cost will be between $200 - $300.
Patrick Bowne requested a non-public session under RSA 91-A:3. (See Non-Public Session Minutes)

Stated that an employee (Roger Nason) had resigned effective
MOTION:
J. R. Swindlehurst made a motion that the Dunbarton
Board of Selectmen accept the verbal resignation of
Roger Nason effective
2. Stated that Alan Sheldon will be cross training for Patrick Bowne and will provide coverage for vacations at Transfer Station and the Highway Department and will also follow through to be certified for the Transfer Station, etc.
3. Presented a thank you note from Mrs. R. L. Brooks. Selectmen recommended putting it in Patrick Bowne’s personnel file.
Jon Wiggin, Fire Chief:
Jon Wiggin, Fire Chief, appeared before the Board of Selectmen. He reported that there were still unpaid ambulance bills after billing the parties three times. After discussion, the Board of Selectmen made the following motion:
MOTION:
The motion was made, seconded and passed unanimously
that the ambulance bills which were still outstanding be deemed uncollectable
and reported under “Uncollected Funds”.
MOTION:
J. R. Swindlehurst made a motion that the Dunbarton Board of Selectmen appoint Jon Wiggin as Fire Chief, and Louis Marcou as Deputy Fire Chief. Charles Graybill seconded the motion and it passed unanimously.
