DUNBARTON PLANNING BOARD

WEDNESDAY,  JANUARY 18,  2006

TOWN OFFICES – 7:00 PM

 

The regular monthly meeting of the Dunbarton Planning Board was held at the above time, date and place with Co-Chairman  Brian Nordle presiding as Acting Chairman.  The following members were present:

Brian Nordle stated the James Marcou, Chairman, had sent his resignation from the Dunbarton Planning Board to the Board of Selectmen.

 

Meeting Posting:

 

The Acting Chairman Brian Nordle verified with the Secretary that the Public Meeting Notice had been posted in three public places throughout the Town and published in the Concord Monitor for one day.  In addition, the Public Notice was put on the Dunbarton Web Page. 

 

Approval of Previous Month’s Meeting Minutes, Wednesday, December 21, 2005:

 

MOTION:

 

Michael Poirier made a motion to approve the Minutes of the Wednesday, December 21, 2005 Meeting as written.  Kenneth Swayze seconded the motion.  The motion passed unanimously.

 

7:00 p.m. – PUBLIC HEARINGS (CONTINUED)

 

KATHRYN SCHUMACHER (B5-3-3 & 4) PROPOSED LOT LINE ADJUSTMENT LOCATED ON KIMBALL POND ROAD IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH

 

Kenneth Swayze presented a Status Report on the Schumacher Request for a Lot Line Adjustment.  (attached)  He noted the Society for the Protection of New Hampshire Forests has concerns about the proposed Lot Line Adjustment which they have asked be addressed prior to the Lot Line Adjustment being granted. 

 

Jacques Belanger, Surveyor, appeared before the Board on behalf of Kathryn Schumacher and stated they had met with the SPNHF.  According to the Society, Ms. Schumacher has to confirm that there is no extraordinary  financial gain if she alters the lot lines.  It is a problem that needs to get resolved before we can move on.  The Society is not getting any more or less of an easement if the Lot Line Adjustment goes through.  According to them, the original owners put it into a Conservation Easement with tax deductions, therefore no further gain can be made from the property (other than that which would be ordinarily realized, such as inflation).  They only receive the property if the Town “screws up” which is very unlikely.  Ms. Schumacher cannot take advantage of a profit again.  

 

Kenneth Swayze noted there is some legal basis for this thinking.  Unfortunately, our attorneys are also the attorneys for the Society therefore we cannot seek their advice.   The matter has been discussed with the Municipal Association Legal Departmetn.

 

The Board noted the 65 day period will be up next meeting.  The applicant would request a 90 day extension.   The Board agreed to request it from the Selectmen.

 

MOTION:

 

Kenneth Swayze made a motion to continue the Kathryn Schumacher request for a Lot Line Adjustment.  Michael Poirier seconded the motion.  The motion passed unanimously.

 

SITE PLAN REVIEW/SUBDIVISION  - SUMMERHILL CONDOMINIUMS (DUNBARTON 88) CONSISTING OF 83 UNITS LOCATED OFF ROUTE 13 SOUTH AT THE COUNTRYSIDE GOLF COURSE IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH

 

Kenneth Swayze reported that our Legal Counsel had contacted us to notify us that the Golf Course would not be on the agenda this evening. 

 

The Board noted the Summerhill Condominiums Project would require a 90 day extension to continue.  The Board agreed to request a 90 days extension from the Dunbarton Board of Selectmen.

NEW BUSINESS:

 

                Stinson Hills:

 

Kenneth Swayze reported that Stinson Hills, LLC, Mansion Road (Lamontagnue Builders) would be seeking to put a new bond in place for Stinson Hills, Phase II.  Currently, they are proceeding at risk for Phase II and have made substantial progress.  The bond would allow for the filing of the Phase II plan, which would then subsequently allow for the sale of lots and issuance of building permits. 

 

Mert Mann stated that Stinson Hill Road is scheduled for a Public Hearing on Thursday, January 27, 2006 for the acceptance of the Phase I portion. 

 

Site Plan Review Regulations Rewrite:

 

Alison Vallieres reported that the Town had received three bids for the rewriting of the Site Plan Review Regulations as follows:

 

1.        Vollmer Associates LLP

2.        Fougere Planning & Development, Inc.

Milford, NH

 

Phase I – Fact Finding - $3,500.00

Phase II – Research & Analysis (Rewriting) - $5,000.00

 

3.        Central New Hampshire Regional Planning Commission

Concord, NH

 

 

Rewriting the regulations - $4,500.00

Less Approved Grant           1,500.00

 

                Net Bid                        $3,000.00

 

MOTION:

 

Kenneth Swayze made a motion that the Dunbarton Planning Board accept the bid from Central New Hampshire Regional Planning Commission in the amount of $4,500.00 for the rewriting of the Site Plan Review Regulations and taking into account $1,500.00 for an approved grant which will be used toward the cost making the net cost to the Town of Dunbarton $3,000. 00.   David Breault seconded the motion.  The motion passed unanimously.

 

John Trottier, Chairman, Dunbarton Zoning Board of Adjustment, stated he would like to be included in the Workshops for the rewriting of the Site Plan Review Regulations. 

 

Roads Committee:

 

Kenneth Swayze reported that the Roads Committee had not met during the month of January.  The next meeting will be Wednesday, February 1, 2006.
