DUNBARTON PLANNING BOARD

WEDNESDAY, DECEMBER 19, 2001

TOWN OFFICES – 7:00 P.M.

 

The regular monthly meeting of the Dunbarton Planning Board was held at the above time, date and place with Chairman James Marcou  presiding.  The following members were present:

 

               James Marcou, Chairman

               Kenneth Swayze, Co-Chairman

               Alison R. Vallieres, Secretary

               Carter Higginbotham

               Charles Graybill, Selectman

               George Holt

               Brian Nordle

               Michael Poirier, Alternate

 

The Chairman verified with the Secretary that the Public Meeting Notice had been posted in a timely fashion at three places throughout the Town and published in the Concord Monitor for one day.

 

A motion was made to approve the minutes of the previous meeting of Wednesday, November 21, 2001 as written.  The motion was seconded and passed unanimously. 

 

7:15 p.m. – FINAL PUBLIC HEARING FOR THE FOLLOWING PROPOSED CHANGES TO THE LAND SUBDIVISION CONTROL REGULATIONS:

 

  1. POLICY AND PROCEDURE REGARDING ERECTION OF BUILDINGS ON CLASS VI HIGHWAYS AS ACCEPTED BY THE DUNBARTON BOARD OF SELECTMEN ON 8/2/01.  (COPIES AVAILABLE AT THE TOWN OFFICE.

 

  1. RECOMMENDATION OF A MINIMUM ROAD FOOTAGE OF 600 FEET ON NEW ROADS IN NEW SUBDIVISIONS (NOT INCLUDING CLASS VI ROADS) AS DIRECTED BY THE BOARD OF SELECTMEN.

 

  1. ADOPTION OF INDIVIDUAL FIRE SUPPRESSION OR SPRINKLER SYSTEMS IN INDIVIDUAL HOMES AS AN ALTERNATE TO PRESENT FIRE SUPPRESSION MEASURES WITHIN THE DUNBARTON SUBDIVISION ORDINANCES.  (COPIES AVAILABLE AT TOWN OFFICE)

 

  1. ANY OTHER DISCUSSION RELATING TO PROPOSED CHANGES IN THE SUBDIVISION REGULATIONS.

 

The Chairman read the public notice and the Planning Board decided to immediately go to Article 3 re Individual Fire Suppression or Sprinkler Systems in view of the fact that the Deputy Fire Chief was present.

 

Several items within the Proposed Ordinance were suggested by the Planning Board to be changed as follows:

 

Page 1 in the first paragraph re the Intent should have a phrase added to read as follows: 

 

“To provide an alternative to constructing a fire suppression water source for new homes within subdivisions as may be ordinarily required by the subdivision regulations.”

 

Page 2 next to the last paragraph from the bottom should change as follows:

 

“All attached structures or those that are located under living spaces shall be protected by the sprinkler system”.

 

Page 3, should remove  the entire paragraph re the Disclaimer.

 

Bud Marcou, Deputy Fire Chief, stated that he was comfortable with the Proposed Ordinance as written.

 

The Chairman noted the following members would be voting on the Proposed Residential Sprinkler Code as presented with the above amendments.

               George Holt

 

Carter Higginbotham made a motion that the Dunbarton Planning Board accept the Dunbarton Residential Sprinkler Code as presented by the Fire Department with the above amendments.  Kenneth Swayze seconded the motion and it passed unanimously.

 

  1. POLICY AND PROCEDURE REGARDING ERECTION OF BUILDINGS ON CLASS VI HIGHWAYS AS ACCEPTED BY THE DUNBARTON BOARD OF SELECTMEN ON 8/2/01 (COPIES AVAILABLE AT TOWN OFFICE)

 

MOTION:

 

Kenneth Swayze made a motion that the Dunbarton Planning Board include a comment in the Town of Dunbarton Subdivision regulations regarding the already implemented policy of the Dunbarton Board of Selectmen concerning building on Class VI roads that the Planning Board neither approves nor disapproves this policy insofar as the Planning Board was not requested to participate in the procedural formulation of this policy.  The motion was seconded by George Holt and passed by a majority vote with Charles Graybill abstaining. 

 

George Holt asked for a recap on the policy and Charles Graybill explained that this basically is a procedure which was approved by the Selectmen that the Town will not accept any proposals to obtain building permits on Class VI roads that exceed 300 feet from a Class V road unless the road is brought up to Class V standards .  Basically puts a damper on developing off Class VI roads. 

 

Charles Graybill stated that the road standard is basically the same as the Planning Board has been using in the past. 

 

James Marcou stated that the Planning Board should have had input from the beginning but he did agree with the language. 

 

Mark Tarsa – Mansion Road.  Stated that under the old procedure, residents could sign a waiver and build on Class VI roads. 

 

The Board noted that if you are beyond 300 feet on a Class VI road now, you must upgrade the road to Class V standard. 

 

Brian Little – Stated that the present three Selectmen voted on this issue and that two of the Selectmen have personal interest in lands off Class VI roads and therefore should have stepped down from the Vote.  Was the Ethics Committee contacted re this issue.  How could a vote take place when there is a conflict of interest.?

 

Charles Graybill, Selectman – Stated that the vote did take place and there is no record of Ethics issue.  He stated the Selectmen took a vote and did not grant themselves any benefit.  The vote was actually more negative to themselves than positive. 

 

Brian Little asked if they felt it is in this Town’s interest to allow Class VI roads.  More people would want Class VI road developed etc.

 

2.      RECOMMENDATION OF A MINIMUM ROAD FOOTAGE OF 600 FEET ON NEW ROADS IN NEW SUBDIVISION (NOT INCLUDING CLASS VI ROADS) AS DIRECTED BY THE BOARD OF SELECTMEN.

 

MOTION:

 

Kenneth Swayze made a motion that the Dunbarton Planning Board include a comment in the Town of Dunbarton Subdivision regulations that the Town of Dunbarton per the Board of Selectmen will not accept new and/or proposed subdivision roads less than 600 feet in overall travel length, not including turn-around provisions.  The Dunbarton Planning Board generally concurs with this position.  The motion was seconded by Alison Vallieres and passed unanimously. 

 

NEW BUSINESS:

 

Charles Graybill, Selectmen, read a draft letter from the Selectmen regarding the Proposed Fred Weston Subdivision.  The contents of the letter were as follows:

 

“Dear Mr. Marcou and Members of the Planning Board:

 

At the December 13, 2001 meeting of the Board of Selectmen drafted an outline of what the town would like to see for conditions regarding the above proposed subdivision.

 

These conditions are:

 

1.      A through road from Mansion Road to Everett Road.

2.      The subdivision road cannot exceed 8% grade.

3.      That five (5) acres be given to the town adjacent to the town garage including a buffer zone and the road coming out.

4.      Everett Road be upgraded, especially at the intersection of Everett and Route 13, with a level platform and the correct drainage.

5.      Delineation markers on the abutting properties to the intersection of Route 13 and Everett Road.  The police department suggested curging.

6.      A Hammer Head – west of the intersection.

7.      The width of Everett Road (now 2 rods) would be 24 feet of travel way.

8.      The removal of trees.

 

The letter was read into the Dunbarton Planning Board’s record showing timely attention by the Selectmen. 

 

Mark Tarsa noted he would be directly affected by the proposed subdivision because his driveway on Mansion Road  would be directly across from the access road to the subdivision.

 

Dave Breault – Stated he was a concerned resident and asked if the Board knew what the lay of the proposed road would be. 

 

The Planning Board stated they haven’t even got a formal application for this subdivision yet so could not comment on details at this time. 

 

There being no further business, the meeting adjourned at 8:35 p.m.
