DUNBARTON PLANNING BOARD

WEDNESDAY, OCTOBER 17, 2001

TOWN OFFICES – 7:00 P.M.

 

The regular monthly meeting of the Dunbarton Planning Board was held at the above time, date and place with Chairman James Marcou presiding.  The following members were present:

 

               James Marcou, Chairman

The Chairman verified with the Secretary that the meeting had been posted in a timely fashion at three places throughout the Town and published in the Concord Monitor for one day. 

 

The minutes of the previous meeting of Wednesday, September 19, 2001 were approved as amended with the following amendments:

 

  1. On page 3, second paragraph in the section re Faustini should read as follows:

 

“easement to be 25 feet from the right of way line” instead of “tree cutting to be 25 feet of the centerline”.

 

  1. On page 4, first paragraph on the page re Faustini should read as follows:

 

An agreement that existing house sale may proceed” instead of “In agreement that one house lot will go for sale.”

 

3.      On page 4,  third paragraph re Zylak should read as follows:

 

the Town” instead of “they”.

 

PUBLIC HEARINGS:

 

7:00 P.M. – PROPOSED JAN VANDEBOGART ELEVEN (11) LOT SUBDIVISION LOCATED ON MONTELONA ROAD IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH

 

At this point in the meeting, the following members stepped down from the Board because of a conflict of interest:

 

               Charles Graybill

               Michael Poirier

               James Marcou

 

Kenneth Swayze was acting Chairman and the voting members were those left at the table as follows:

Kenneth Swayze noted the following:

 

  1. Don Mayo has sent letter stating he has reviewed plan and that the plan has been revised to include changes recommended in plan review dated August 15, 2001, etc.  (attached).

 

  1. It was noted that the applicant has received a waiver for the sprinklers instead of a fire pond. 

 

(At this point in the discussion, Kenneth Swayze stated he had received several calls from concerned residents that the first granted subdivision of three lots was not included in the sprinkler waiver, therefore these three lots have no requirement for either a fire pond or sprinklers.   The Board agreed that this situation was out of the Board realm and there was nothing that could be done about this because the lots have been sold and a house is already on one lot, etc. ) 

 

The Fire Chief will address this situation for the future when writing the changes in the Fire Pond/Fire Protection Ordinance which is in the process of being amended. 

 

It was noted that the sedimentation and erosion bond will be provided to the Selectmen in the amount of $5,000.

MOTION:

 

Kenneth Swayze made a motion that the Dunbarton Planning Board approve the subdivision of Jan VandeBogart, a major subdivision consisting of eleven (11) lots at Montelona Road, Tax Map C6, Block 3, Lot 2 subject to the following conditions:

 

1)     Receipt of all State and any other approvals or permits required, including, but not limited to New Hampshire Wetlands and Site Specific (as may be required).

 

2)     That each approved “phase” be completed in total, and in particular the phased engineered roadway be completed and built in strict compliance with the approved plans and Town of Dunbarton sub-division regulations; and that the Town of Dunbarton accept the completed roadway phases as Class V highways.

 

3)     That the final plans (mylars) may not be signed or filed at the Registry until such time as all conditions of approval have been met.

 

Alison Vallieres seconded the motion and it passed unanimously.

 

PUBLIC HEARING – RICHARD AND DAVID ZYLAK PROPOSED THREE LOT SUBDIVISION LOCATED ON ORDWAY ROAD IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH

 

At this point in the meeting, James Marcou, Charles Graybill, and Michael Poirier stepped back on the Board.

 

Jacques Belanger presented the plan.  Stated there had been a site walk on Tuesday, October 2, 2001 which was well attended. 

 

George Holt noted that the requirement from the Selectmen for the cutting of trees seemed excessive.  

 

After discussion re the tree cutting, it was noted that the Planning Board would not intervene in the Selectmen’s suggestions of tree cutting.  It was noted there is very little traffic on this road and also that the Selectmen are not planning to do anything in the near future regarding the cutting of trees.  Noted that it has no bearing on the proposed subdivision.

 

Kenneth Swayze stated he agreed with the Selectmen and the Road Agent re the cutting of trees.

PUBLIC HEARING – MICHEL BELANGER/JAMES AND JACQUELINE MICHAUD/BRAD ASBURY PROPOSED LOT LINE ADJUSTMENT LOCATED ON JACQUELINE DRIVE AND ROBERT ROGERS ROAD IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH

 

At this point in the public hearing, Charles Graybill, Selectman, reported that all conditions regarding the easement area have been met.  The easement area for drainage has been moved.  Have met with Selectmen and it is all set.

PUBLIC HEARING – JOSEPH M. BEAUCHEMIN PROPOSED TWO LOT SUBDIVISION LOCATED ON RANGEWAY ROAD IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH

 

Jacques Belanger, Surveyor, noted that they had added a driveway to the southerly lot.  Other than that, there have been no changes to the plan.  Corners have been set.  Existing house is to be razed.  There is a note on the plan re tree cutting. 

 

The Board noted that all buildings should be razed prior to any building permits being issued.

PUBLIC HEARING – LOUIS FAUSTINI PROPOSED FIVE LOT SUBDIVISION ON BLACK BROOK ROAD AND LONG POND ROAD IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH – ADDITIONAL PUBLIC HEARING FOR THE SIGNING OF APPROVED SUBDIVISION AND CORRECTION OF ABUTTERS LIST AND ABUTTER ON PLAN

 

It was noted that the Town had received the signed waiver from the abutter which was not properly notified (Richard and Donna Jones) but that the waiver had not been notarized. (attached)

 

In addition, Mr. Faustini has requested that the $50.00 fee for the notification of abutters be waived.  (attached)

MOTION:

 

Kenneth Swayze made a motion that the Dunbarton Planning Board not accept the request for the waiver of the payment of $50.00 for additional notification of abutters.  The motion was seconded by Michael Poirier and it passed unanimously.

 

It was noted for the record that two full public hearings had been held with official notification of the correct abutter, Richard and Donna Jones. 

 

The public hearing was closed.

 

 

 

DECISION RE JOSEPH BEAUCHEMIN PROPOSED TWO LOT SUBDIVISION:

 

Charles Graybill made a moton that the Dunbarton Planning Board approve the Joseph Beauchemin proposed two lot subdivison of Lot D4-2-2 on Rangeway Road subject to the following conditions:

 

1.      The trees need to be cut and stumped or ground on the frontage of the property.

 

2.      All buildings on the property shall be razed prior to any building permits being issued.

 

Kenneth Swayze seconded the motion and it passed unanimously.

 

DECISION RE MICHEL BELANGER/JAMES AND JACQUELINE MICHAUD/BRAD ASBURY PROPOSED LOT LINE ADJUSTMENT:

 

Charles Graybill made a motion that the Dunbarton Planning Board approve the Michel Belanger/James and Jacqueline Michaud/Brad Asbury Proposed Lot Line Adjustment on Lot E5-2-5 & 13 on Jacqueline Drive and Robert Rogers Road with no conditions attached.  The motion was seconded by Kenneth Swayze.  The motion passed unanimously.

 

DECISION RE RICHARD AND DAVID ZYLAK PROPOSED THREE LOT SUBDIVISION LOCATED ON ORDWAY ROAD:

 

Kenneth Swayze made a motion that the Dunbarton Planning Board approve the Richard and David Zylak proposed two lot subdivision of Lot C7-2-7 located on Ordway Road with the following conditions:

 

1.      Tree cutting and removal by the applicant thirty (30) feet from the centerline on the applicant’s side or reach an equivalent or otherwise satisfactory agreement with the Selectmen. 

 

George Holt seconded the motion.  The motion passed unanimously.

 

NEW BUSINESS:

 

RECEIPT AND ACCEPTANCE OF NEW APPLICATIONS BY THE DUNBARTON PLANNING BOARD AND START OF PROCEEDINGS:

 

ALAN CUSHING/JOHN KINOSH PROPOSED LOT LINE ADJUSTMENT AND MINOR SUBDIVISON LOCATED ON GRAPEVINE ROAD IN DUNBARTON, NH

 

Kenneth Swayze made a motion that the Dunbarton Planning Board accept the new application from Alan Cushing/John Kinosh Proposed Lot Line Adjustment and Minor Subdivision located on Grapevine Road in Dunbarton, NH  and begin proceedings this evening.  Charles Graybill seconded the motion.  The motion passed unanimously.

 

Jacques Belanger, Surveyor, appeared before the Board representing the applicants.  In addition, Mr. Cushing was present.  J. Belanger presented a preliminary plan showing the proposed lot line adjustment and subsequent subdivison, etc.  He stated the new proposed lot will use a 40 foot access strip to enter the lot.  This will keep the driveway away from wetlands.  The acreage of the back lot will be 23.5 acres.  The easement will be across Cushing’s lot. 

 

The Board asked if the West’s were aware that there will be a driveway right next to their house. 

 

Jacques Belanger stated he will give them a copy of the plan.

 

George Holt asked about the status of Meadow Road and who owns it.  Stated he felt the Board should have a clarification on the status of Meadow Road. 

 

A site walk was scheduled for Tuesday, October 30, 2001 at 5:00 p.m.

 

The item will be on the agenda as a public hearing next month.

 

OTHER BUSINESS:

 

Country View Golf Course Property

 

It was noted for the record that all discussions were informal and not binding on the Board. 

 

Brian Devellis, Landscape Architect, appeared before the Board.  He stated he had a client who was interested in purchasing Country View Golf Course and would like to develop it either into condominiums or residential housing.  It has not been determined at this point whether he would keep the golf course or not. 

 

His client would be considering 40 units on 250 acres.  The Board explained that possibly he might be interested in having a joint meeting with the Zoning Board because of the possibility of a PRD. 

 

The Board noted that Dunbarton has a requirement of open space with regard to PRD’s and that a golf course would not be considered open space because it would not be available to all the public, etc. 

 

Fred Weston Property, Everett Road

 

It was noted for the record that all discussions were informal and not binding on the Board.

 

Jacques Belanger, Surveyor, presented a informal plan showing a proposed 15 lot subdivision on the Fred Weston Property on Everett Road.

 

The proposal showed a 13.57 acre open space area which is a wet area.

 

The Board noted that they would expect that the proposed roadway into the property be extended to Everett Road so that it would not be a dead end road.  This is within the Town’s Master Plan.   It was noted that the lot is within the Town’s Medium Density District thus the lots can be three acres instead of five. 

 

The Board noted the following:

 

1.      Improvements to be made to Mansion Road

2.      Access road should be continued to Everett Road

3.      Wetland should be mapped.
