DUNBARTON PLANNING BOARD

WEDNESDAY, JUNE 20, 2001

TOWN OFFICES – 7:00 P.M.

 

The Dunbarton Planning Board held its regular monthly meeting at the above time, date and place with Chairman James Marcou presiding.  The following members were present:

The Chairman verified with the Secretary that the meeting notice had been posted in three public places throughout the Town and published in the Concord Monitor for one day. 

 

The minutes of the previous meeting of Wednesday, May 16, 2001 were accepted with the following corrections:

 

1.  Page 3, 8th paragraph – George Holt noted that when he asked Mr. Todd about wetlands on the property, he only was making reference to the parcel of interest and not the entire lot.    The statement should read as follows:   “George Holt asked if there were any wetlands on the property, particularly referring to the building site, and not the entire parcel.”

 

2.  Page 3, 4th paragraph – Kenneth Swayze noted that the discussion regarding road paving should read as follows:   Replace the second sentence making reference to paving to read “Paving is not negotiable.”

 

7:10 p.m. – RECEIPT AND ACCEPTANCE OF NEW APPLICATIONS BY THE DUNBARTON PLANNING BOARD AND START OF PROCEEDINGS:

 

PROPOSED LOT LINE ADJUSTMENT AND SUBSEQUENT TWO LOT SUBDIVISION BETWEEN THOMAS J. GIOVAGNOLI/JAN VANDEBOGART/DAVID GLANNON LOCATED ON MONTELONA ROAD/TWIST HILL ROAD AND MORSE ROAD IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH

 

Kenneth Swayze reported that he had reviewed the application and it appears to be generally complete.  Noted that the Board had some discussion with applicant on various options. 

 

MOTION:

 

Kenneth Swayze made a motion that the Dunbarton Planning Board accept the application for a Proposed Lot Line Adjustment and Subsequent Two Lot Subdivision between Thomas J. Giovagnoli/Jan VandeBogart/David Glannon located on Montelona Road/Twist Hill Road and Morse Road in the Low Density District in Dunbarton, NH and start of proceedings.  George Holt seconded the motion and it passed unanimously. 

 

Jacques Belanger, Surveyor, appeared before the Board on behalf of the applicants.  This is the former Godbout property.   He presented a plan showing the proposed Line Adjustment and subsequent subdivision.  The object of the Lot Line Adjustment is to provide sufficient frontage for Tom Giovagnoli to be able to subdivide the parcel into two lots.  Frontage will not be contiguous for the second lot.  Frontage will be on Morse Road (obtained from David Glannon) and Twist Hill Road.   Total acreage of the new lot will be 7.75 acres. 

 

George Holt asked how much acreage is within the “strip”.  Jacques stated that Glannon’s portion will be .66 acres and VandeBogart will be .44.   Jacques stated he had proposed that the connecting strip be 40’ wide to make sure that the parcel could not be further subdivided. 

 

Kenneth Swayze noted that there should be a note on the plan that this frontage on Morse Road can never be separated from the original parcel or further subdivided. 

 

Chuck Graybill asked if Jacques had spoken with the Road Agent to determine if there is a need for easements, etc. for future road improvements.   Need to make sure there is sufficient sight distance on Twist Hill Road.  Jacques will get together with the Road Agent.  The Board noted that they will all look at the situation together.

Daniel/Monique Roux – Present, concerned about future building on the back piece behind.  Concerned about the right of way and being able to put up many houses. 

 

Jacques Belanger indicated that the strip is only 40’ wide and this is not wide enough for a road for subdivision within the Town of Dunbarton.  The driveway for the new lot will be on Twist Hill Road. 

 

Nancy LeBlanc asked why the driveway could not be on Morse Road.

Jan VanDeBogart – Stated he had some concerns because he intends to build a house down there and asked if the strip has to be that wide.  Could they make it 15 feet instead of 40 feet.  Stated he was already limited to where he can locate the septic system and this will further restrict him because of the setback of 50 feet.  Would like to make the strip none usable to prevent possible future owners from using it for snowmobiles, etc.  As it is, he stated he is surrounded by wetlands. 

 

Kenneth Swayze indicated there should be some reasonable use of the land.  He also noted if there is some substantial change in the plans, the Board needs to know two weeks in advance of the next meeting. 

 

The Board stated it seemed  there are concerns that all parties must work out amongst themselves to determine particulars of the Lot Line Adjustment and Subsequent Subdivision prior to the next meeting.

Nathan J. Narus – Present, stated he would like to know if there is a standard for a right of way.  Looked at the plan.  Stated he was concerned about the standard for the right of way. 

 

James Marcou stated there was no standard for a right of way in Dunbarton at this time.  

 

Kenneth Swayze indicated this strip was not a right of way.  It is a connecting piece of land and the landowner has the only rights to use it.

Robert/Dorothy Perry – Mr. Perry present, stated he lives on Morse Road.  Stated that the strip would become a problem down the road.  Had the same thing with his four unit building.  Going to be a problem in the future.

The Board noted they will schedule a site walk prior to the next meeting.  In addition, the plan will require test pits and soil log.

PROPOSED JAN VANDEBOGART ELEVEN (11) LOT SUBDIVISION LOCATED ON MONTELONA ROAD IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH

 

Kenneth Swayze stated that he had reviewed the application and found it to be generally complete.  Was sure there will be questions from the Board.  He noted that some lots have already been broken off.  Noted there were no deeds included with the application. 

 

Jan VanDeBogart is the only owner of the property.  The Board noted there will be engineering questions.  Have received paperwork for the wetlands application.  May come under site specific.  May require phasing because of the number of proposed lots.  The Board noted this is a major undertaking.  Will be the first bonded road under the new guidelines.  Approximately 3,200 feet of road and there are substantial wetlands on the property. 

 

MOTION:

 

Kenneth Swayze made a motion that the Dunbarton Planning Board accept the application for the Proposed Jan VandeBogart Eleven (11) Lot Subdivision located on Montelona Road in the Low Density District in Dunbarton, NH and start deliberations this evening.  The motion was seconded by George Holt and passed unanimously.

 

Jacques Belanger, Surveyor, appeared before the Board on behalf of the applicant.  He presented first plan showing the proposed 11 lot subdivision. 

 

At this point in the discussion, George Holt stated he was concerned about where the fire pond would go. 

 

Jan VanDeBogart indicated he had spoken with the Fire Chief  and he did not indicate at this time where he would want a fire pond in the area or whether he would want another fire pond dredged out in return, etc.  Jan will coordinate with the Fire Chief. 

 

The Board noted that this eleven lot proposed subdivision will have a total impact of 14 lots because of the others previously sold, etc.  This proposal is breaking up the remaining property.

The road  length is 3,200 feet and will be built to Town Specifications from one end to the other. 

 

It was noted that wetlands have been mapped by Peter Schauer, Wetlands Scientist.  Total lot is 73 acres.  Jan will be building his house in the remaining back corner on 20.49 acres. 

 

Jacques Belanger, Surveyor, indicated he had built in 15 foot utility slope easements.  Town should have the right to make repairs in the future if needed.  After discussion, it was decided that the applicant would probably give the Town slope easement rights. 

 

The Board noted there were no culverts shown on the plan at this time.

 

Also there was no drainage report. 

 

Kenneth Swayze indicated there were some engineering deficiencies. 

 

Board indicated erosion stone should be used for anything over 5% grade on ditch lines. 

 

The Board indicated they will refer to the Town Engineer. 

 

There is an 8% grade on the main road coming in to the subdivision. 

 

Board indicated they will need a construction and  bonding schedule.

 

The applicant indicated he would like to get this approved in one phase. 

 

The Board indicated the Fire Pond requirement would have to be done right away.

It was indicated that the applicant has to do construction to assure there is no siltation, etc.

George Holt indicated he would like to have a detailed sediment and erosion control plan and would like to know where the Fire Pond is going to be located. 

 

A site walk is scheduled for Friday, June 29, 2001 at 6:00 p.m. and will meet at Twist Hill Road.

PROPOSED TOM AND CAROL HOGAN TWO LOT SUBDIVISION LOCATED ON ROBERT ROGERS ROAD IN THE LOW DENSITY DISTRICT IN DUNBARTON, NH

 

Kenneth Swayze reported that he had reviewed the application and found it complete.  He noted it met the Town requirements for frontage and acreage.

 

MOTION:

 

Kenneth Swayze made a motion that the Dunbarton Planning Board accept the application for the Proposed Tom and Carol Hogan Two Lot Subdivision Located on Robert Rogers Road in the Low Density District in Dunbarton, NH and begin deliberations this evening.  The motion was seconded by Greta Brandt and it passed unanimously. 

 

                It was noted that Peter Schauer had mapped the Wetlands six weeks ago. 

 

                Driveway locations should be discussed with the Road Agent. 

 

                It was noted that the size of the two proposed lots would be 10.94 acres and 8.67 acres.

At this point in the meeting, Jan VandeBogart, Road Agent,  stated there would be a possibility for a need for an easement to the Town to straighten out the curve and this should be included within the final plan, etc. 

 

The site walk will be done the same time as the VandeBogart site walk, Friday, June 29, 2001 at 6:00 p.m.

 

There being no further discussion, the public meeting was closed.

 

OTHER BUSINESS:   Louis Faustini – Informal Discussion

 

Louis Faustini appeared before the Board to discuss a proposed two lot subdivision he would be proposing in the near future. 

 

He stated he had already applied to the Wetlands Board prior to applying to the Planning Board in order to get things in order, etc. 

 

He stated that the Wetlands Board upon the recommendation of the Dunbarton Conservation Commission has granted the Wetlands Permits on the basis that there be a “shared driveway” between the two lots. 

 

At this point in the discussion, it was pointed out that the Dunbarton Planning Board does not condone shared driveways.  They cause many problems including funding for mortgages, etc.  The Board noted the small amount of wetlands that would be disturbed for these two driveways was minimal and saw no readon to have a shared driveway.

 

It was pointed out that the Dunbarton Conservation Commission should work in conjunction with the Planning Board in matters such as this one.  Before making a recommendation to the Wetlands Board, they should “touch bases” with the Planning Board. 

 

In addition, Louis Faustini pointed out that the underground house has a potential buyer and the driveway extends onto one of the proposed lots.  The Board recommended that he change the driveway so it appears on the appropriate land with the underground house. 

 

OTHER BUSINESS:  Jacques Belanger re the Robert Ray/Michel Belanger Lot Line Adjustment Final Mylar:

 

The Board indicated that Kenneth Swayze would review the plan before signatures were obtained.  This is the plan which was lost in the Town Office, etc.
