Bryan Clark made the motion to accept the minutes of November 18, 2003.  John Swindlehurst seconded the motion, all were in favor.

 

Intent to Cut Timber:  Matt Michie, who is cutting on land owned by the Army Corp. of Engineers, has filed an intent to cut timber on lot E2-1-1.  It was decided to charge taxes in advance because this is a “non-owner”.   The board suggested that the taxes be figured on the high side of scale because of the quality of the timber.

 

Current use penalties: The following current use warrants were signed as voted on at the last meeting of the board:  Gregory & Hope Arce, E3-2-47 in the amount of $7500;  Daniel & Michelle Morin, E3-6-3 in the amount of $9500;  and Eric & Hillary Hodgman, E4-3-4 in the amount of $2100.    

 

The ratio forms were reviewed and signed.  They will be mailed to DRA certified mail.

 

Ed and Marcia Wagner, H3-4-8:  The Wagners had an appointment to speak with the Assessors.  This was a follow up with the board in regard to his current use penalty assessment.  Mr. Wagner felt dissatisfied with the answer he received from the Board because the issues discussed at the September 16, 2003 were not addressed.  He was not concerned about the date of disqualification but the other issues were not addressed.  (See minutes of September 16th)  He stated that the board did not give a map or any other documentation.  If there is no documentation he felt he would have to go to state level.  John Swindlehurst stated that the land was purchased for $79900 and that was what the penalty was based on.  Mr. Wagner stated that only two acres were disqualified, the total acres amounted to 22 plus acres.  John stated that when current use is altered the total piece is disqualified.  Mr. Wagner did not agree.  John read from the current use laws to substantiate what he said.   Mr. Wagner still did not agree.  Mr. Wagner stated he was willing to accept the date of current use disqualification used by the Board.  This was the date the foundation was poured.  But he does not accepted penalty amount based on the acres taken out.  He stated that the builder told him that the current use penalty would be between $4500 and $5000 and  this was amount agreed at the closing.  The builder (Rick Martin, Right Way Builders) told Mr. Wagner that he was told by someone at the town level that the penalty would be between $4500 and $5000.  According to Mr. Wagner’s calculations,  it figured to be  $4500 to $5000 and he is prepared to go to the state with this calculation.   The  Board recommended that he goes to the state.  John Swindlehurst  stated that he felt that the board had treated Mr. Wagner justly.  Mr. Wagner stated that he  was disappointed that the town does not have to meet the same standards that he does.  He said the letter he received from the board did not address his two issues.  He also stated that he had nothing new to present at this time.  Mrs. Wagner expressed her disappointment that they had prepared all this information and that the board had ignored it.  John Swindlehurst said that the Board did not ignore their information but stated that the letter was sent and it said all.  The board reviewed the three points and gave a simple letter.  

 

Mr. Wagner asked if copies of  tape recordings of the September 16, 2003 meeting were available for him to purchase.  He was presented copies of the tapes along with an invoice for $35.00

 

Mr. & Mrs. Wagner left the meeting.

 

Brian & Kimberly Little, F3-03-13:  Compton was asked by the Board to go back to review the property after the last meeting.  When Compton reviewed the property in early December, he made a very minor adjustment of $50 in the assessment so the  abatement stands as voted in November.

 

Budget for 2004:  The board completed their proposed budget for the year 2004 to be presented to the Board of Selectmen.  The budget is as follows:

This is a $4000 increase over 2003.

 

John Swindlehurst made the motion to accept the budget, Bryan Clark seconded the motion, all were in favor.  Motion passed.

 

Mike Leach & Valerie Clegg, J3-02-02M1:   A $10.23 tax bill was mailed on this but the mobile home was destroyed by fire.  The Board was asked to abate the taxes.     John Swindlehurst made the motion to abate the taxes on J3-02-02M1 in the name of Leach and Clegg; Bryan Clark seconded the motion, the motion passed.

 

 

Bids for Revaluation of properties:  The following bids were received:

 

1.      Cole layer Trumble Company -  $134,500

2.      Vision Appraisals -  $102,800

3.      Earls Nieder Perkins, LLC  -  $84,500

4.      Avitar Assoc. of NE -  $111,200 (Includes software)

5.      Nyberg Purvis & Associates  -   $101,775

 

The Board voted to meet on January 6, 2004 at 7PM at the Town Office to review the bids.
